Research On The System Of Bordering Relationship With The Vision Of Environment Right

In this paper, the author starts with the normative analysis of traditional civil bordering relationship system. With the vision of "private protection of environment right", the author clearly points out that traditional civil bordering relationship system can not protect the bordering environment (personality) right by holding and deconstructing the characters of environmental bordering relationship. To break through the immanent system obstacles, we should explore the traditional personality right law and then found the system of environment personality right, and complement with environmental tort legal system. Only in this way should the environmental bordering relationship be regulated comprehensively.In addition to preface and ending, the paper consists of five parts.The first chapter is the normative analysis of traditional civil bordering relationship system.The second chapter details the basic theory of environment right.The third chapter is the theoretical analysis and system positioning about environmental bordering relationship.The fourth chapter is to investigate extraterritorial legal systems of environmental bordering relationship.The fifth chapter is to totally discuss our legal systems of environmental bordering relationship from what it is to what it ought to be.
