On Commercial Secret In The Government Information Disclosures System

In order to satisfy the needs of the public interest,the Right to Know requires the government information can be opened maximally.However, the realization of the public interest should not damage the private interest, the private information held by the government has a great relation to the private interest,which should be protected including trade secret.In this paper,the author took the natural content and ownership of trade secret as a starting point,summed up the legislation status quo of trade secret protection in China's current government information disclosure system, at this point developed in-depth researches on causes and issues of china's trade secrets protection,then analyzed the necessity of trade secrets protection system in government information disclosure under the guidance of the basal theories of Law and Economics,and analysis the trade secret protection in United States government information disclosure system which has a certain reference for our country,finally proposed some improved concepts for China's corresponding system.
