An Analysis On The TRIPS From The Angle Of The Adjustment Range Of WTO

As the coming of knowledge economy,people have been paying more and more attention to the Intellectual Property Rights issue.As the legal and institutional foundation of the multilateral,the WTO also attached great importance to this issue.It signed an agreement TRIPS in 1994 to specially process for this issue.What cannot be denied is that international trade closes touch with the Intellectual Property Rights nowadays,so the WTO should establish a rule for the Intellectual Property Rights issue which is really related to the international trade. However,what is disappointed is that the content of the TRIPS is out of the adjustment range now.Such a lot of trade unrelated issues came into the TRIPS,and which makes a series of negative effects.Therefore,in order that promote the expansion of the international trade and ensures that world trade flows freely,the TRIPS should adjust its content and make itself keep to the original purpose of the WTO.The paper falls into four sections.Part one briefly introduce the development of the adjustment range of the WTO and the inception and growth of the TRIPS.Since the founding of this system of multilateral trade,the adjustment range of WTO expanded continuously,even some trade-unrelated issues have be introduced into this system,including the Intellectual Property Rights issue.Part two mainly analysis the reasons of the TRIPS coming into being.The TRIPS was brought out is not by chance and there are some reasons behind.The reasons not only exist outside WTO system,but also come from the WTO inner system.For these kinds of reasons acting together,the TRIPS came into being at last.Part three is the part analyzes the irrationality and injustice of the TRIPS from different angles.On the one hand,this rule is irrational.It shows a big legal defect and it brings an erroneous demonstrate.Also the TRIPS breaks the general rule of the development of the international protection of Intellectual Property Rights.On the other hand,what is worse is that it brings injustices and affects the order of International Economy.Part four is about how to better System of the international protection of Intellectual Property Rights and how to conceive the rules of TRIPS.We should pay attention to the Intellectual Property Rights issue and make the effort to better system of the international protection of Intellectual Property Rights.But all should be discussed just in the forum of Intellectual Property Rights.And as the rule in the world trade organization,TRIPS should carry out reforms and adjust its content to make itself keep to the original purpose of the WTO.
