Research On The Compensation For Mental Injury In The Product Liability

Product Liability and safety have been the most important problem in global economic market.In recent years,it has also become a serious problem in the Mainland China.It is not only the causes of the consumer's bodily injury and property loss but the causes of mental damages.In order to provide a full protection to the consumers' rights,we have to establish a better compensation of mental injury in the product liability besides the traditional product liability.The aim of this thesis is to study the compensation for mental injury in the product liability.First,this paper expounds the relative definitions of compensation of mental damage in product liability and emphasizes on the differences between the compensation of mental injury in product liability and the general compensation of mental injury and their significances and values of study.Secondly,we attempt to study on the different systems of legislation,range and amount of compensation between the Mainland China,European countries and the America and the inspiration to our developing of the compensation of mental injury and punitive damage.Finally,we will discuss how to establish the compensation of mental injury in product liability in this field.Also,we may give some suggestions to the legislative branch,such as the range and amount of compensation in the product liability and we come up with enhancing the compensation of the punitive mental injury system and the ways of giving necessary support and relieves to the consumers who suffered from the causes of the mental damages in deficient product. Meanwhile,we may also let the public realized the development of our market economy and the participation of every citizen play the key role in order to protect consumers' interests.
