The Marriage Law Protection To The Value Of Women's Housework

Housework is essential to maintain a family,educate children and support elders. Housework,as a private work,is always associated with women.Women are the main labor of the housework,however,which has heavily hindered the women to step into the productive fields of society and affected the development of them.Moreover,it has aroused more and more family contraditions for its heavy and unplayable character.But few people acknowledge the economic and social value of the housework.Therefore,from the point of law,we must acknowledge the economic value of the housework and protect it.The amended Marriage Law of China admits the value of housework by prescribing by community property system and request for compensation for housework.However,the legislation is not perfect, the legal system of compensation for housework on divorce has some defects on its scope of application,grounds of application,forms of application and restriction of application that should be completed when the legislative amends the law of marriage.The article attempts to make a study of this phenomenon from the Marriage Law, admits to truly protect women's rights through legislative measures.The desertion consists of three parts:introduction,text and conclusion.The text is divided into three chapters.Chapter One demonstrates the basic conceptions associatetd with housework.In this part, it introduces the conception of domestic labor,the value of housework and the characters of the housework.Chapter Two summarizes three legislative patterns by comparing and analying the representative provisions as to the value of housework of seven countries and areas.It hold that the situation of a country should be first considered when we make choice among the matrimonial property system in the legislation of the value of housework;if the matrimonial property system cannot embody the value of housework,remedy system should be resorted;and by the improvement of the legislation,maintenance support system can be adopted.Chapter Three discusses current situation of legislation of the value of the housework in China and its limitations.It hold that dual protection patterns combing the community property system and request for compensation for housework can effectively protect the interests of the weak in the marriage life,but application both instituial obstacles are still existing the end,the dissertation puts forward several suggestions on the polishing of legislation based on the analysis of defects of request for compensation on housework.
