The establishment of law results from multiplicity of culture,and curse,swear and pledge's failure to coordinate human relations between individuals and between individual and society.Despite the dominance of law,"rules otherwise" do not simply disappear but still work in an effective way in our society.Although undergo the decline of Christian Culture in the Middle Ages,In a long run,the old witness's oath system has yet been playing an important role in western lawsuit activities of today,and become more perfect. In china,we can sums up that we have never abandoned this old tradition from the traces of the system in such practices ranging form ancient plight to the《swearing ordinance》decreed by Nanjing Civil Government in 1930s.Nowadays,our academicians begin to focus on the way to establish the swearing system according to the situations of our country.This article,through the comparative methods,attempts to comb and summarize the history of swearing system in China and foreign countries,analyze the relationship between oath system and belief,and make a tentative probe and analysis to the belief foundation of our witness's oath system.
