Studies On Easement

Easement is a kind of other property right that set on others'real properties so as to make such properties profitable to persons who set this right. It is very important to have clear distinguishes between easement and adjacent relation, because although they are all ways to adjust the relationship between real properties owners', they differ in legal natures and practice as well.It is very urgent for us to deal with such conflicts between easement and other usufructuary real rights. Both as real rights, those rights have no difference in effect essentially. But in the situation that we cannot consider both of them fairly, an"ORDER"is badly needed. This thesis aims to make an analysis of such conflicts.In"Real Right Law of the People's Republic of China"which has been passed in 2007, easement has been put in Chapter IV, Part III. However, the law of easement should be improved by time. There is some suggestion to improve the system of easement in this paper, such as add some specific kinds of right of easement.
