The Improvement Of People's Mediation System During The Course Of Building A Harmonious Society

Building a harmonious socialist society is a major strategic objective of the Chinese Communist Party and The Chinese Government in the new era, An important aspect of the building a harmonious society is to establish effective dispute resolution mechanism, including the improvement of people's mediation system. The people's mediation is an unique non-litigious dispute resolution mechanism of china, it's very important in resolving conflicts and disputes and maintaining social stability , including the maintenance of the grass-roots social order, the realization of civil autonomy, regular the social morals and manners and achieve justice entities and so on. With these important influences, The improvement of people's mediation has great significance to build a socialist harmonious societyHowever, a series of new situations and problems emerged in the people's mediation at present. The performance focused on the expansion of the people's mediation system, the scope where the People's Mediation Committee can be established , who can be the people's mediation presenters, what kinds of disputes that the people's mediation can accept and hear a case, and the task of mediation are all expanded to exceed the original designs of the people's mediation. The existence of these problems have had a series of serious consequences, not only take disvantanges to the ideas and practice of the rule of law, but also to the development of a variety of mediations system. many facts should account for these. on the one hand, the contradictions and disputes of our social life becoming more and more in the new era and the people's mediation committee established in village(neighberhood) committee can hardly to cope with .at the same time ,plenty of new mediation types arising ,while they can not find their legal basis of their existence , they run into the camp of the people's mediation one after another .On the other hand, for the sake of influenced by the trend of thought of the rule of law for a long time, we had a misreading and prejudices of the people's mediation, and has not a clear understanding of the nature of the system, which led to a serious lack of standardized design of the system. Therefore, in order to improve our people's mediation system, first of all, the concept of the people's mediation system must be clarified, and should be clearly defined as the mass organizations of self-government which established in the village (neighborhood) committees. On this basis a series of measures can be taken to improve our people's mediation system, Including the strengthening of the standardize constructions of the people's mediation system ,the increasing of the support to the People's Mediation Committee from the grass-roots level people's government, and The establishment of the convergence mechanism between the people's mediation and court proceedings ,and so on.In this paper, the structure is divided into four major parts: The first part narratived the significance of people's mediation system in the building of a harmonious society. Including overview to people's mediation system ,the relationship between harminous society and dispute resolution mechanism ,and so on. The second part analysised the current problems of people's mediation system, including the trouble situations of the people's mediation committee established in village (neighberhood) committee and the expansion of the people's mediation. focused on the performance of cxpansion of people's mediation and it's serious consequences .the third part analysised the reasons why these problems can existence in the people's mediation system at present. The last part gave out some advices to improve the people's mediation system, including the recognize of it's conception and some pecific measures to it's improvement, and defined the people's mediation committee as a mass organizations of self-government which is set up under the village(residents) committees.
