The pledge system on accounts receivable is short time in legal practice field and many relative problems and theories need to be solved and demonstrated.So,it is meaningful to discuss this topic,for financing and current economic development.Through comparing the different systems of the pledge system on accounts receivable in China and other countries,this article focuses on the analysis in the significant theory and practice area,aims to further perfect the pledge system on accounts receivable in our country.Theoretical basis for the research is constructed by way of the inspection history,studying definition,nature analysis and comparison of related systems.As to definition,taking object(or res in Latin) as a clue,Made a pledge of accounts receivable as defined in,With respect to nature of pledge of accounts receivable,this article adopts object matter theory of right.Second,based on legislation and then practice at home and abroad and domestic scholars argued that on the subject of pledge of accounts receivable,to establish and model to do in depth public discussion on this basis,analysis China's pledge of accounts receivable system's strengths and weaknesses.The article agree with a pledge of accounts receivable to be taken in writing the contract,that in order to register as a public model,reflects the legislation of our country to the world's most advanced technology into the Legislative Council.At the same time,The article believe that China's pledge of accounts receivable system for the legislative system mains shortcomings confusion,the subject of a pledge not to design a clear and unreasonable registration system.The last part contains is the aim for this article.The article proposes the related legislative recommendations and drafts the corresponding legislative recommendation articles,in order to promote the perfection of Chinese the pledge system on accounts receivable in future.
