Research On Forms Of Administrative Judgments

Administrative Procredure Law as one of Chinese three procedure law,has important significance to improve our constitutional system. Facts have proved that the administrative procedure law has important fanction for administrative organ to administrate according to law,and protecting the administrative relative persom's legitimate rights and intrests.But the administrative procedure law had mang problems in the implementation,especially the form of judgment.The thesis is divided into four parts.Chapter one is about "summary of the forms of administrative judgments and value of research".In the part,it mostly discusses the concept of the forms of administrative judgments,expatiates the value of research the form of administrative judgments.Chapter two is about "the comparative analysis of the forms of administrative judgments among abroad countries.In the part,it compares and analyses the forms of administrative judgments among abroad countries.Some contents which are helpful for Chinese admninistrative judgments are abstracted.These are propitious to Chinese administrative procedure.Chapter three is about "the provision of administrative judgments in China,the problems and reasons".In the part, through analysis of relevant laws and regulations,it entirely generalizes current forms of adminstrative judgments and its conditions,shows the problems on the practice,analyses its reasons.Chapter four is about "improving Chinese adminstrative judgments",in the part,I canclude the factors which affect the draftting of administrative judgments.On the base of it,I make recommendations about improving and rebuilding of Chinese forms of adminstrative judgments.
