Since 1970s, countries of all over the world have enacted rules and regulations to effectively check the emergence of governmental corruptive behaviors. But due to the limitation of efficacy of the rules and regulations, work of anti-corruption and advocating probity in many countries has not got big breakthrough. China has also been in the dilemma. After surveying the world, America, South Korea, Japan, to pursuit the goal of probity, have successively upgraded administrative ethics into the law, established the law of administrative ethics according with the situation of their own countries, sought the path of legality of administrative ethics. After the above measures, their anti-corruption work got many good results.This paper firstly discussed the necessity and possibility of the legality of administrative ethics that is the necessity of the legality of administrative ethics which comes from the changes of the value in public administration, the variety of the public demand and confuse of the civil service on ethical autonomy. And the possibility of ethics comes from the possibility of legalization; further to analyze the advantages and disadvantages of external control and internal control is an effective way to control the government from outside and inside.Based on the above theory, this paper tried to do a comparative study on three aspects, which is the ethics legislation, law enforcement and supervision over law enforcement in the United States, South Korea, Japan and other countries of the legality of administrative ethics. According to the comprehensive analysis on the legality of administrative ethics in these countries, the author obtained the general rules of the legality of administrative ethics. That are the following measures: to set up the law and regulation system on administrative ethics; to establish a quite independent Ethics Committee to implement the relevant laws; to strengthen the formal supervision and informal supervision in order to promote the effectiveness of the Committee's work.
