The rights to equality is not only the most important social basic rights which is confirmed and guaranteed in the international documents about human rights such as "Universal Declaration of Human Rights" and "the International Treaty for Economic, Social and Cultural Rights", but also the rights which is set by the constitutions in most nations. In recent years, citizen's rights to equality are violated frequently in the acting public service. Lack of relevant law system and disputes of related questions become the obstacles to protect citizen's rights to equality. January 1,2006 China promulgated "Law of the People's Republic of China on Civil Servants", which established the principle of equality, the equality of citizens on the public to play an vital significance for building a socialism harmonious society of great significance. The article begins with analyzing the basic theories of equality, then reveals the harsh reality that citizen's rights to equality are violated frequently and can not be protected legally, finally proposes the establishment of constitutional remedy to protect citizen's rights to equality.The whole content is consisted of preface, text and conclusion. And the text includes the following three parts:The first part is an analysis to the basic theoretical problems of the rights to equality. The path of equal thought, the content of the rights to equality. "China's Law of Civil Servants" has the vital significance in establishing the equal principle. The second part is based on reality, by collecting and analyzing numerous examples, revealing the hash condition that at the present time citizen's rights to equality are violated frequently and can not be protected legally.The third part is discussing to the implementations equal principle. Practically there are disagreements between citizen's rights to equality and recruited institution. China constitution is non-actionable. This part is based on the right to equal protection of foreign theory and constitutional relief.
