On The Study Of The Scope Of Administrative Proceedings By The Case

The scope of accepting cases of administrative procedure as one of the cores of systems of administrative procedure determines the width and extension of judicial protection of natural person,juristic person or other organizations and affects the protected procedure. It is also a legal regulation which resolves administrative provision and rights between people's court and other national organizations and it concerns not only the act of administrative organizations but also judicial act of people's court. In China, because of restriction at certain period, the scope is comparatively small which restricts the legal right of administrative procedure which cannot supervise the administrative act and protect the legal rights of counterpart. So, the paper made a research on the scope of accepting cases of administrative procedure from three aspects: a general introduction and partial analysis on the present regulations of the scope of accepting cases of administrative procedure; an analysis of factors which influence the accepting case of administrative procedure in our country; introduction of the regulations aboard in the field and the proposal of framework of the development of accepting cases of administrative procedure in our country. The aim of the paper is to expand and perfect the scope of accepting cases of administrative procedure in China and protect the lawful rights and interests of the counterpart.
