As the society and economy developing, people are purchasing more comfortable housing. This requirement is causing urban real estate's developing rapidly. With the increasing of buildings in cities, the area is decreasing and the land price is increasing rapidly. In order to build commercial residential housings, some real estate developers are entering villages near cities to look for area. This kind of housing which are built on rural land and are sold to urban population is called housing of small property right. If one buys this kind of housing, he can't get the official property ownership certificate as a city housing buyer. Because the village land is not permitted to be used to build city residential housings on.But this kind of housing has been existing for about 10 years and has reached a large amount. Its exist is both reasonable and illegal. It's reasonable because with its appearance, farmers can earn more money and the villages can become more urbanized. It is illegal because it defends the present law. It involves benefits of many people in. These people include the farmers of the villages, the housing buyers, the real estate developers and the government. So it's a very serious society problem and it need to be solved appropriately. In order to protect the farmers' benefits, in this paper I want to seek a suitable way to solve this problem by making some suitable suggestions on reforming the present land law and land policy and to find a suitable way to solve the problem of housing of small property right.In this paper, the content is divided into three parts: in the first part, I will introduce some notions of this kind of housing; in the second part, I will analyze some conflicts of interest and some different ideas on this question and draw a conclusion that this problem's existing is reasonable, and then I will analyze the reason why this kind of housing is illegal; in the third part, I will make a conclusion for this paper by making some suggestions on reforming the present land law and land policy and thenI'll come to a suitable way to solve this serious problem.
