Constitutional Thinking Of Equal Protection Of The Farmer Right

Equality before the law is the basic principle of our constitution. However, this constitutional principle, not fully reflected in the farmers.Due to various reasons,farmers in our country have received different treatment,they can not equality enjoy the rights which citizens enjoy in politics,the economy and the cultural life.In building a harmonious society today,the realization of the equal protection of the rights of farmers,the realization of the civil rights of the farmers have become an unavoidable reality.The paper will take the angle of view by equal protection of the rights of farmers,through the analysis of present situation of the rights of farmers, to investigate the origin that the rights of farmers who suffer the inequality of treatment,and to explore efficient paths that equal protection of the rights of farmers under angle of view in constitution.Introduction of the paper elaborates the social background in brief, to carry out the necessary logical explanation. The first part of the paper define conotation of the farmer,analyzd the definition of the farmers and farmers who have unique characteristic of our constitution,based on this the paper summarize inequitable status quo of the rights of farmers in our country.The second part set out from the angle of constitution,analyzd the legal basis that equal protection of rights of citizens, establishing the theoretical basis for the following inequitable status quo of the rights of farmers and the way of protection.The third part elaborate the origin of rights of farmers,the part thought that the reason of inequality, except for the forms that city and countryside dual society structure, but also the unequal legislation and flaw of constitutional consciousness of farmers.The fourth part propose thinking of equal protection based on the third part, considering that reform the lateral economic ties,casting off status label of farmers;In addition, we must review mechanism of laws and regulations,draw into the constitutional litigation in order to protect the rights of farmers. At the same time,we must cultivate awareness of rights of farmers,so that they become the real citizens.
