The Study On Shipowners' Responsibilities Of Time Charter Party

This paper is intended to explore the legal issues related to the responsibilities of the shipowners in the time charter contracts by study of the International Convention and the Maritime Code of the People's Republic of China.At the same time,this paper attempts to provide the solutions of shipping disputes and make suggestions for revisions of the Maritime Code of the People's Republic of China combined shipping and judicial practices.There are five chapters in this Paper:Chapter 1 is concerned with the concept and features of the time charter contracts.This chapter is intended to divide the responsibilities of the shipowners and the charterers.Chapter 2,3 and 4 focus on the regular duties and the limitation of liabilities of the shipowners under the current domestic and international charter contracts.Chapter 2 is talked about the shipowners' liabilities for breach of contracts.Chapter 3 studies their tort liabilities.Chapter 4 discusses other responsibilities of shipowners.Finally,according to the present shipping and judicial practices,Chapter 5 pointed out what the specific responsibilities which should belong to the shiponwers and how to assume the responsibilities and try to make suggestions for legislative amendments by comparison of the legislations of Sweden,Netherlands,Japan and South Korea.
