Research On Cross-strait Financial Legal System By Taking Example From The Content Of CEPA

This article is based on the guidance of historical materialism and dialectical materialism,using economic law,financial law,regional economics theory and so on Comprehensively,In accordance with the mode of problems- putting forward,problems-analyzing,problems-solving,Drawing on the content of CEPA and making a more systematic and comprehensive analysis to improve the construction of cross-strait financial legal system.With the increasingly close Combination of global economic and trade exchanges, Hong Kong and Macao promote their own economic development After the implementation of CEPA,and meanwhile give a negative impact on Taiwan's economy. So it Forces the economic and trade relations of cross-strait especially in co-operation between the financial sector to contact each other frequently,the needs which Includes the establishment of financial institutions,currency exchange,corporate finance, financial tax incentives,as well as other various forms of financial services are growing strongly.However,there are many difficulties between the cross-strait financial exchanges.Laws and regulations of the financial have seriously affected the process of cross-strait financial legal system at this stage.This paper firstly expatiates on the status quo of cross-strait's financial legal system,and then finds out the main problems between them.This paper brings forward references that can be used in cross-strait's financial legal system by the analysis of the contents and characteristics of CEPA,and further improves useful proposals in the cross-strait's financial legal system sequentially.Moreover,this article also discusses the problems that must to be solved and then puts forward proposals to solve them in cross-strait's financial legal system.This paper is divided into six parts which are including the introductions,the status of cross-strait's financial legal system,the main problems existed in cross-strait's financial legal system, the analysis and reference from the closer economic partnership arrangement between Mainland & Hong Kong & Macao,recommendations and conclusions which can improve the process of cross-strait's financial legal system.
