Legal System Study On Patent Protection In Chinese Universities

World Intellectual Property in the current highly competitive context,countries play a greater emphasis on the role of research-oriented universities,and universities at the same time strengthen of patent protection to ensure its smooth development of the knowledge-based economy driven.In recent years the development of China's university's patent is rapid, especially in quantity of patent applications,and especially Zhejiang University has been top of patent applications in academic institutions in the world for three consecutive years.China's university's patent protection laws and regulations are constructed continuously,and it is closely related to the significantly contributed of the protection law to the development of university's patent.However,the applied patents in China's universities are not very high quality,and the results of the patent transformation rate is still not with the United States,Japan and other developed countries in the same breath,the value of the patent has not been fully realized. Therefore,we need to complete the patent protection laws and regulations,and make the patent play its due role in the innovation system.In this paper,with the data analysis of the quantity and quality of the world patent application in universities,compared with the status of legal protection of university's patent at home and abroad,with deep analysis of the issue and the reasons of patent protection in China's university,give the recommendations of how to complete legal system of patent protection in Chinese universities.This article is divided into four parts.The first part is about the concept of patent protection of universities,the historical development of legal system of patent protection of universities and its function.The second part describes the measures of patent protection of universities of foreign countries,the United States and Japan,for example,especially focus on the Act of the patent transformation.The third section describes the patent development in Chinese universities and the state of protection legal system;further more analyze the existing problems and reasons of legal system of patent protection in Chinese universities.The fourth part is about the suggestions of how to complete the legal system related to the patent protection in Chinese universities through borrowing ideas from the developed countries.
