Property Declaration System Studies

In this paper, based on absorbing the results of the previous studies, starting with the backround and the meaning of the subject selecting, highlight the motivation and the purpose of the paper writing; Expound candidatly the content , the function and significance of our existing proterty declaration system ,and introduce several legislative models of the system at home and abroad in detail,"the German sworning system"as the focus, in order to learn from them effectively; Probe deeply the legal basis of the system and believe that the legal basis of the system mainly includes four aspects: Principle of good faith is the virtue basis of the property declaration system, principle of efficiency is the utilitaian basis of the property declaration system, maintain the rights of creditors so as to achieve social justice and safeguarding the authority of judicial dicisions in order to defense a country's order; analyze detailly the current running situation and the existing lack of our property declaratinon system.On the basis,to improve the property declaration system in our country ,two aspects should be adequate under the effort :the further improvement of the system itself and the establishment of related systems.
