On The System Of Civil Prosecutorial Supervision In Our Country

The system of Civil Prosecutorial Supervision being late start and the deficiency of the theoretical research and legislation is important one in our country, which needs be improved. With the deepening of ruling the country according to law, citizens and corporate bodies keep enhancing their qualities of law and is gradually aware of mediating the conflicts and safeguarding interests through judiciary. Thus our ideologies must make further progress and provide the theoretical guidance for practice through the theoretical analysis and discussion of contacting closely practice, which can help us find out the practicable way to solve the problem. Now set "On the System of Civil Prosecutorial Supervision in our country" as my title, the dissertation gives some assumptions and specific suggestions to improve the System of Civil Prosecutorial Supervision from different aspects.This dissertation is divided into three parts except introduction and conclusion. Now I will introduce the main body separately.At the beginning, the first part in my thesis mainly makes the detailed analysis about the basic theories of Civil Prosecutorial Supervision from two aspects. The first aspect talks about setting up the fundamentals of law according to Civil Prosecutorial Supervision. Both sides that the Civil Prosecutorial Supervision is a means and implementation of justice is the goal are pointed out through elaborating the relationships between the theory of justice and the Civil Prosecutorial system. The second aspect discusses the establishment of the institutional fundamentals in accordance with Civil Prosecutorial Supervision.The second part is to analyze the current situation of the Civil Prosecutorial Supervision in our country. First of all, I analyze it from the current two ways and supervision proposal of the Civil Prosecutorial Supervision. Then the second side will elaborate from the results of Civil Prosecutorial Supervision in recent years. The last aspect of this part will focus on its main current issues.The third part is the improvement of the System of Civil Prosecutorial Supervision. In this section, I, first of all, combining with advanced legislative theory, experience and the reality of our country, put forward the basic idea for improving the supervision system, and consider that the relevant laws and regulations should be adjusted. Finally in order to settle the problems of legislation defect and supervision dislocation resulting to our country's great loss, the last side will present that we should establish the new monitoring system and highlight the commonweal supervision system.
