The Analysis To "Vanke Donation Events" From The Legal Point Of View

The charity activities of various companies for Sichuan Earthquake have attracted much attention from the public. Of all these companies, specially, China Vanke, the leading residential real estate developer in Mainland China, was pushed into the spotlight because of its relatively small donation (2 million CNY) and controversial comment made by its chairman of the board, Shi Wang, i.e. it was totally appropriate for China Vanke to donate 2 million CNY. From this affair, which is usually called "Vanke Donation Events", we can find that there're still many work to do in evaluating corporate charity activities and developing the legislation for public charity.The paper will analyze problems reflected by "Vanke Donation Events "from the view point of law. The paper consists of four parts:The first part: "Vanke Donation Events"and problems reflected. This part gives the detail of "Vanke Donation Events" and the public response, and thus introduces the theme of this paper, i.e. discusses related issues from the legal view point.The second part: The view in the eye of law on several key issues of "Vanke Donation Events". This part discusses the effect of corporate charity to the goal of making profit, the criteria for judging corporate social responsibility, and the guideline and practice for corporate charity. In this chapter, the positive effect of corporate charity to earning profit is identified; the significance of corporate charity in evaluating the corporate social responsibility is clarified; the questions on how to carry out corporate charity and whether Vanke's donation is legal are also answered from the view point of law.The third part: Problems of China legislations on corporate charity reflected by "Vanke Donation Events". This part tells facts that there's no regulation on corporate social responsibility currently in China, the mechanism combining inspiration and constraint of corporate charity together has deficiencies, and that there's no legislation on emergency donation for sudden disasters.The last part: Countermeasures to complete legislations on corporate charity. Against the problems discussed in the third part, some countermeasures are proposed: Firstly clarify the responsibility of companies to the society. Secondly, complete the mechanism combining inspiration and constraint of corporate charity together. Thirdly, develop legislations on emergency donation for sudden disasters. Finally ,introduce the Law of Charity Promotion.
