Administrative decision-making organizational system is a general term to refer to official power, structure and relationship of organs and personnel assuming administrative decision-making obligations fixed by a system. A scientific administrative decision-making organizational system is the organizational guarantee of administrative decisions. Modern administrative decision-making organizational system is composed of several relatively independent as well as united administrative decision-making systems and the most important parts are central administrative decision-making system, consulting system of administrative decision-making system, administrative decision-making information system and supervision system of administrative decision-making.The present paper examines and analyzes legal issues of administrative decision-making organization system in China from the following three aspects. Firstly, a theoretical analysis of the four fundamental elements (including central administrative decision-making system, consulting system of administrative decision-making system, administrative decision-making information system and supervision system of administrative decision-making) of administrative decision-making organizational system in China is given. Secondly, the present paper analyzes the existing laws and regulations of administrative decision-making organizational system in China and their inadequacy, and analyzes legal problems existing in the four sub-systems respectively. The main problems are that the decision-making power in central administrative decision-making system is too centralized and there is no clear cut boundary between decision-making power as well as the legal protection issues in decision-making information transparency in administrative decision-making information system and so on. Thirdly, the present paper proposes concrete measures for perfecting the administrative decision-making organizational system in China with China's actual conditions and existing laws and regulations into consideration and emphases that administrative decision-making procedures should be determined in the form of legislation and further establishes and perfects the information openness, hearing and supervision systems of administrative decision-making. |
