In 1982,audio-visual materials were defined as a separated means of legal evidences,which was quite distinctive as most other countries classified these materials into documented evidences.Nevertheless,because the time of the emergence of audio-visual materials was only a few years ago,so related legislative theories were quite immature.And with more and more recognition put on the protection of people's privacy,the legality of secretly recorded audio-visual materials has attracted much discussion.The regulations of audio-visual materials in China's standing laws and judicial interpretations are not sufficient and lack exercisability in practice,so different courts have different attitudes toward secretly recorded audio-visual materials.The deficiency in legislation has hampered audio-visual materials from exerting their effects as an independent means of evidences.Mature laws are needed in juridical practices.The reconstruction of regulations to validate audio-visual materials in civil procedures has got its urgency.The dissertation has started the study of the problem from the legal definitions of secretly recorded audio-visual materials.After comparisons of juristic validations of these materials in other legal systems,existing regulations in China have been thoroughly analyzed and certain regulations on the validation of secretly recorded audio-visual materials have been reconstructed.
