Research On The Law Of Computer Software Reverse Engineering

As the 21st century's emergent industry and the sunlight industry, the software industry plays an important role in creating wealth and promoting social development. And it has become a great power to promote the socio-economic development. The development, sale, use and other economic activity of software industry take lots of legal issues. Those issues are more and more concerned in legal science domain. This paper launches the discussion on software development's technological means - -reverse engineering. In our developing country, the development of software industry was still at the initial stage. So various question of software reverse engineering appear unceasingly in the judicial practice. Those make the legal protection of software's intellectual property rights inadequate. Therefore, the purpose of writing this thesis is due to clear the legal status of software reverse engineering in our country's intellectual property rights legislation, and provide the important theory basis in the judicial practice.This article's main research mentality bases on the Chinese native software industry, and pays great attention on the combination of theory and practice. Some research methods such as comparison, analysis and induction are used in the article. These methods make the proof have the persuasive power and the modernity. Through referring the mature legislative and judicial experience of foreign countries, I provide some personal advices on how to perfect the legal protection of software reverse engineering in our country.Overall, the legality of software reverse engineering will become the development trend of world economy, and give impetus to software industry development. Therefore, our law needs to further establish its legitimacy, in order to provide an operating platform and infrastructure for the judicial practice, and ensure the realization of rights of public access to knowledge and information.
