The Feasibility Study On Building System Of Sentencing Suggestion System Of Procuratorial Authority

The thesis exames sentencing suggestion system of procuratorial authority to find inner problems and analyzes reasons of it. From the point of comparative jurisprudence, the thesis displays revelation for us through foreign sentencing system and gives suggestions of how to solve problems from the angle of cognizace and legislation. The thesis uses existing condition analysis,deductive reasoning and comparative study to get conclusion that we should take advantage of sentencing suggestion system of procurator to make up limitations of exercising public prosecution. The thesis has four parts:Chapter one discusses necessity and feasibility of sentencing suggestion system of procuratorial authority. The author thinks that the procurator exercising public prosecution only shows conviction claim, sentencing suggestion as one part of public prosecution has not been implemented fully. The author thinks that it is necessary to extend and regulate conviction claim of prosecutor and to set up sentencing suggestion system of procurator in accordance of modern criminal proceedings under the mode of the prosecution and the defense system.In chapter two and three, the author analyzes development,effection and existing prolems of sentencing suggestion system in China first, then through comparing sentencing suggestion system in two foreign chains contries to expalin that it is suitable to develop sentencing suggestion system in china and it will solve disadvantages the current criminal conviction brings.In chapter four, the author thinks sentencing suggestion system starts not long ago, it should be improved in explicit legislation,scope of application,range,time,way and details, to set up a set of system of sentencing suggestion that is suitable and feasible for China.
