Research On National Customary Law Of Ewenki

As a fact that Legal pluralism is generally accepted, the civil law has become a hot spot in the research. The Legal pluralism thinks that in the legal history of mankind, the civil law has a great effect on Social order. In this paper, I take the grass-roots community of Ewenki Social as an Example, to explain my opinion. The article includes the following sections.Part I: Ewenki customary law and its social functionThe first part of this paper, According to the analysis of the Ewenki customary law in order to show its Actual result at Basic unit society, and on this basis further elaborated its Social function.Part II: The relationship between Ewenki customary law and National lawIn this part, by the analysis of the relations between the Ewenki customary law and statute law and pointed out there is both Supplementary and Conflict between them.Part III: The adaptation to conflicts between Ewenki customary law and national lawBased on the analysis of above-mentioned part, this part discuss about through give fall play in Legislative, judicial and law enforcement to resolve the conflict between Ewenki customary law and national law, as well as Point out that improving the function of Village rules which is made by the rural grass-roots self-government organizations will to be an effective solution to the conflicts between Ewenki customary law and national law.
