China's System Of Group Litigation Dispute Research

These years, with the development of our country's economic ,a lot of group conflicts are taking place, more and more people give their attention on the group litigation. But, in China, our deputy action system have some defects. This paper is at the basic of reviewing types of the group litigation system in foreign countries, include American Germany and Japan, combining with the condition and reality in our country, puts forward some opinions of the reformation and modification of the group litigation system in china, to wish that can have some help for modify our group litigation system. The paper introduce the summarize of group litigation system, then discuss the basic theory of group litigation system. On the basic of that to compare some foreign countries' group litigation system, include American's class action system, Germany's group action system and Japan's deputy action system, I introduce the current of the group litigation system in china and the defects in this system. At last, I put forward some assume on the reformation and modification of the group litigation system in china, and propose that the reformation should be on the basic of the stead of the society ,should be step by step ,to reflect the group litigation system's function of to resolve dispute.
