Research On Objection System In The Civil Executon

The thesis is focused on the objection that the third party proposed to the civil execution procedure and behavior, the author has been examined and reflected how to save the current situation which the third party's right was damaged, trying to construct the access to this problems. The thesis stated the conceptions of the third party, executing the objection, and the lawsuit of objection, moreover, it demonstrated the classifications and its theoretical bases, and compared the legislative cases of the common law and civil law and borrowed some advanced experiences. On this basis, the author has stated clearly the concrete regulations and deficiencies of the revising "civil trial law". Thethesis emphasized the two different the third party relieving system--proceduraland entity's relieving in the equal, efficient and power-limited principle. Theauthor has set up the various accesses--execution objection and lawsuit wasexamined and trialed in according process. At the same time, the author believed that, executing the relieving system is a kind of system in the civil executing process; it must carry on in accordance with the reformation of execution system.
