| As an important means of modern administration, administrative confirmation can prevent and refrain from social conflicts. Developing administrative confirmation theory, not only improve the administrative ability, but also define the legal relations between the administrative subjects and administrative counterpersons which do favor to protecting administrative counterpersons' legal profit. However, because of some reasons, administrative confirmation is identified only as a theoretical concept. There are different viewpoints existing in basic theory and administrative problems in the practice of administrative confirmation, which has caused confusion in administrative legislation, enforcement and judicature. This is not proportionable to the percentage accounted for and the role played by administrative confirmation. Therefore, it is necessary to classify, summarize and analyze the theoretical and practical issues related to administrative confirmation.The article classifies and analyzes the theoretical issues related to administrative confirmation with the methods of comparing analysis and testing analysis. In particular, it is made clearly that the nature of administrative confirmation is a specific administrative act by the analysis of its features. All of these lay a steady foundation for the following parts. Through the comparative analysis of administrative confirmation and the other related concepts, include administrative license,administrative adjudication,administrative registration .etc, the administrative confirmation has a clearer definition. Analyzing the unfavorable current situation of administrative confirmation, and then, the author offers some suggestion to resolve these problems. So the paper focuses on an exploration of administrative confirmation with the aims of constructing the whole theory of administrative confirmation and providing theoretical references for China's practice of administrative confirmation. |
