Study On The Dispute Settlement System For Chinese Overseas Investment

Nowadays, with the globalization of trade and investment, Chinese overseas investment has made a great amount of growth. With the development of overseas investment, there are so many disputes between host country and Chinese investors in the foreign countries. If we can not resolve well this kind of dispute, it will hinder the development of Chinese overseas investment .The traditional resolution methods have some defects of their own, it becomes an urgent demand for international community to develop a new system of dispute settlement for overseas investment. Therefore, how to build up a perfect dispute settlement system is the main topic that the author tries to deal with.On the basis of analyzing problems that exist in traditional investment dispute settlement system for Chinese overseas investment, and combing Chinese practice related to the system of dispute settlement for Chinese overseas investment, this paper propose some views which may help China to better utilize the system of dispute settlement for overseas investment to solve overseas investment disputes.This thesis includes four Parts:Part I is a brief account of the dispute of overseas investment;Part II is the analysis about traditional investment dispute settlement;Part III is the analysis of the system of the dispute settlement for Chinese overseas investment;Part IV is about the construction of system of dispute settlement for Chinese overseas investment.
