| Real estate belongs to capital intensive industry and needs a large amount of capital. To support the development of real estate industry, China has introduced pre-sale system from Hong Kong. Commercial house pre-sale, as an important real estate development, financing and trade method, has become the main method of sales. But with the wide promotion and application of commercial house pre-sale system in practice, some weakness and shortcomings in pre-sale management system are gradually exposed and lead to affairs of infringement on pre-buyers' legal rights, such as repetitious sales, low quality, unfinished project and "no match", which are very common.So, centering around the protection of the rights of pre-buyers and basic on the fact that it is not proper to cancel commercial house pre-sale system at current stage, this paper analyzed relevant regulations in commercial house pre-sale law system. Basic on the conclusion of shortcomings in present system, author has brought forward suggestions about perfecting relevant legislation on commercial house pre-sale system hopping to provide certain reference to maintaining the rights of pre-buyers and perfecting China's commercial house pre-sale system. |
