Study On The Structure Of Perjury Crime

Recently, there are a lot of researches on the perjury crime and some problems disputed. Resolving these problems do good to the academic research and judicial practices. As we know, the structures of the crimes is the core conception in the penal law. In china, the four essential factors of the criminal structures should all be met well when any crime is sentenced. Any criminal research need to refer to the structures of the crimes. So, the research on the criminal structures is the basic and pragmatic work.In this paper, to clarify the theoretical and practical confusions, the author starts the research with the most disputed problems of the four essential factors, analyzes any factor of the perjury crime, and puts up her own suggestions for the confusions. The research is systemic and detailed, and proceeds in the following aspects. (1) The criminal object. The author reviews the prior researches on it and induces her own opinions. (2) The objective of the perjury crime. In this part, the author mainly discusses the perjured acts, such as the judge of the false act, which is the important and ambiguous in the judicial practices. (3) The subject of the perjury crime. The author furtherly discusses the judge of the witness and recorder, which are the edge problems in the academics., to perfect the researches on the adequate subjects in the related areas.(4)The subjective of the perjury crime. In this part, whether the special criminal purpose is the essential factor in the perjury crime is the mainly concern, and this problem is also discussed drastically in the academic area.
