An Analysis About Why And How Debtor Avoid The Implementation And Concerned Countermeasures

The problem of execution is one of the hot issues in the current society, and it has puzzled the court for a long time. This problem has become an important barrier in the process of managing state affairs according to law. The solution of the problem means a lot to protect the rights of the creditors,maintenance the dignity of law,and promote the growth of the economy healthily.The form of the problem of the execution rooted from the combination of many inner and outer factors. The settlement of the Problem of the execution is the systemic engineering, so we should suit the remedy to the case.The article aspects from the reasons of the problem of execution, analying how the debtor impede the process of execution., and put forward countermeasures correspondingly. Part II defines the concept of the problem of the execution anew, to distinguish the problem of the execution from other concepts. Part III introduce the current flaws which lead to the problem, including macro and micro two aspects. part IV and part V are the focal points of this article ,introducing the main ways taken by the debtor to avoid been executed and the countermeasures we can take.Through the above analysis, to solve the problem of the execution, besides taking strict measures to hit the bad faith debtors currently, to perfect the current law system and integrity system is the key way to solve the problem fundamentally.
