The Influence Analysis On Real Right Law To The Real Estate Industry

The real right law has been put in force on the 1st October in 2007 by ten years and seven considerations. As an essential law about real rights, it closely links peoples' the most important property rights——the real estate,so it was greatly regarded by people from it was drafted to passed .This paper studies the urban housing demolition system,the real property registration system and building discriminate proprietary right system, and their influence respectively to the exploiture,distribution and area property management of the real estate industry. The real right law is an essential law, so its articles are mostly principles and difficult to carry out. In order to make up the limitation, this paper will put forward some feasible proposals.This text firstly compares the housing demolition system between in our country and foreign areas, then found models by the theory of game to have a qualitative analysis. On the basis of that, we analyze the influence of the real right law to our urban housing demolition and put forward some advices to perfect the housing demolition system, especially define "public interest", the precondition of land expropriation in the real right law.Secondly, the text analyzes the main problems in the distribution area of real estate industry by the pop cases, then studies three real estate registration system and their effects to the real estate distribution and put forward several advices to the uniform registration system of real property.Finally, the paper sums up the actuality of the area property management in NanJing by the questionnaire research, then analyzes the influence of the real right law to area property management and protecting the rights of owners and especially have studies on the ownership of the car parking zone and the legal nature of proprietor committee.
