On Restorative Justice And Its Reference To China's Victim-Offender Mediation System

Restorative justice is a criminal case resolving system on the basis of the traditional criminal justice. Compared to the retributive justice; restorative justice is a criminal treatment which achieves the restorative effect adopting the restorative procedure. Restorative justice conflicts in some extent with our traditional judicial culture and the present criminal procedural system, but it also has the intrinsic resources for the implement of restorative justice.There are four chapters in this text. The first chapter is the introduction of restoration justice. In this part, we will understand the concept of restorative justice, the implement of the judicial practice in other nations and the effort of the United Nations to promote restorative justice.Chapter two introduced the concept, features and functions of restorative justice. Restorative justice has many fundamental changes, such as the nature of crime, crime countermeasures, and the concept of justice and the assumptions of the judicial process. It has four Notable features. Restorative justice for the general prevention and special prevention has fully efficient with the traditional criminal justice. In addition, restorative justice also has the benefit of victims and rehabilitation of community relations.The third chapter takes about the correspondences and conflicts between restorative justice and our traditional criminal justice. There is no civil society in our concept and the use of restorative justice will counter to the present judicial system. But restorative justice and the China's traditional judicial culture have many things in common, and it has practice and social development foundation for the implementation of restorative justice.Chapter four is the thinking of China's current victim-offender mediation system. We should uphold reconciliation of restorative justice, to Improve victim-offender mediation system.
