On The Employer's Civil Liability

The employer bears civil liability for the employee's work include two sides. One side, the employee action infringes a third party's rights and interests, the employer should compensated to the third party; on the other hand, the employee's action makes himself to be injured, the employer should compensated to the employee. Both belong to the category of the employer's responsibility. In the actual action, some cognizance standard for is different for the employer's civil compensation responsibility, for example: how to confirm the enploy relation and the conditin that the employer shoud bear the civil responsibility; and how to distinguish the enploy relation and other similar law relation. In this paper, the author uses for reference the theories of the employer's civil compensation responsibility in the world, and combines the actual, experiences, the author has carried on a research and investigating for the employer's civil compensation responsibility. By the ways of comparison and giving examples, the author elaborates some problems about the employer's civil compensation responsibility system, and the author puts forward some advices and ideas to establish the employer's civil compensation responsibility system in China.
