The Research Of Non-market Economy Status Under Special Safeguard Aimed At China

After 15 year's tough negotiations, China has joined the World Trade Organization finally in December 11, 2001, becomes the 143rd member of WTO. But simultaneously stipulated in a series of WTO agreements, China must accepts special safeguard mechanism used by other members toward to Chinaese export products. Because including American, European Union's some World Trade Organization members still did not acknowledge China for the complete market-economy at present, still treated as China "the non-market economy" or "in the reforming market economy" the treatment.Negative influence of disadvantageous terms legislated in "Protocol on the Acession of China" and " Report of the Working part on the acession of China" has come out while Chinese export developing. In the direction of "special safeguard clause",other WTO members may launch an attcak in view of the Chiaese product. It is more easier for import-member to investigate and make a judgement to Chinese products or take the Chinese products as the shifting domestic contradictory tool. In addition, according to the stipulation of preventeing the trade shift , the China export products bitter experience chain-reaction and besieges and pursues the possibility which will block off also greatly to increase.The financial crisis are sweeping across the whole world, causing global economy to decline in some degree, and have already affect various countries' entity economy, so, the WTO various members trade protectionism had gains ground. In order to protect their domestic industrys, suffer enough jobs and spur the economic development, most of members will decide will adopt the harsher import policy. Under such situation, our economy will load so much pressure because of the high dependence of trade. It is easy to get a concolution that the trade industry will survive more harder.At this point, China has been the member of WTO for seven years. "The non-market economy status" ,as one matter of the negotiations, has been the fact today. It does not make any practical significance to discuss the legitimacy of "The non-market economy status". Therefore, what China needs to do at present should not be again excessively many discussions and the complaint, but should acknowledge disadvantageous provision objective existence and the rational analysis deal.This article is take special safeguard to China as the breakthrough point, and analyze the "the non-market economy status" influence to our country foreign trade development rationally, finally proposed that deals with the plan.
