The Humanitarianism In Criminal Correction

This paper is focus on the criminal correction with humanitarianism, and reflects upon the penalty of deprivation of freedom, prison and criminal correction, Attempts rightly to discuss the modernization of criminal correction reasonably.To explain the background of criminal correction, the beginning of this thesis discusses the hypostases of crime in society , indicates crime is the extreme antisocial behavior, and has its own inescapability. The communist party and government 's authority as the most powerful class will not allow this act of crime for it's breach of social peace and order, and then the extreme antisocial behavior is forbidden by the way of law and authority'violence, individual who crime will be punished and civilized under compulsion. Criminal correction is part of this kind of civilization in execution of criminal judgment and ruling , and as a utility theory criminal correction varies during the change of society and science. In China this theory based on the thought of criminal legal system, combined with anthropology, sociology and psychology, emphasis on the behavior of individual, to make criminal do things that in social forbearing.According to legal principle, criminal correction has close relation to the punishment of freedom, especially in China, most criminal are executed the fixed-term imprisonment which in a lockup situation. The modern penalty of deprivation of freedom is a negative to capital punishment and corporal punishment, which more humanitarianism. It denies brutal and unrecoverable punishment, regards human itself is the purpose, not the means. So criminal correction based on humanitarianism serving as an essential component is the goodwill of communist party and government 's authority. In our country, reformation through labour is the main theory, after Disintegration of the Soviet Union and drastic changes in eastern europe, it transfers to criminal correction.In China's reality, the penalty of deprivation of freedom executes in prison most. The prison is undertaken majority of criminal correction. So this thesis goes on to discuss the rights and obligations criminal in prison, and elaborates the history of modern Chinese prison. The paper also points out the trend of criminal correction in development which should have spirit of humanitarianism, and presents the significant of information technicalization and property punishment.In summary, this paper has the idea that criminal correction is a part of execution of criminal judgment and ruling that the core is humanitarianism, and as the development of reformation through labour, which is beneficial to the construction of goodwill society.
