The Study On Criminal Lawyer Of Agent System

Agent system of criminal lawyer has been great neglected in China for a long time in theory and practice of community. It not only reflect some suitlaws have not been given enough attention, such as civil rights of victim,private prosecutor and incidental civil paties have not been given due attention, but also there is a big flaw has exsit in the system of our criminal procedural system. In fact, the agent of criminal lawyer has play a very important role in criminal proceedings of the criminal justice entities, the realization of procedural justice and legal efficiency. Based on it, I tried to anaylse the criminal proceedings to conduct a more comprehensive research of the system.This paper has based on the basic theory of the criminal lawyer of agent system ,elaborate the connotation of the criminal lawyer of agent system, and investigated the course of development of this system and the system of our ststus criminal legislation. Analysis the basic theory of the criminal lawyer of agent system, There are some shortage in the types of agent , the rights and obligations of the proceedings, as well as other relevant provisions. The article further analysis the necessity and feasibility of the of criminal agent system and put forward a perfect indictment, on which the suitlaws of lawyer in the indictable case ,private prosecution case ,attached to civil case and criminal appeal case .protect the rights of criminal agents in order to safeguard the legitimate rights and interests of victims more better.
