Supplementary Investigations System

Supplementary investigation system, as a remedy of the criminal investigation, the law of our country has made the system relatively detailed. Though the investigation is not the process all criminal cases must be going through, it contributes a lot to the smooth progress of the Code of Criminal Procedure, but as for in the judicial practice, there are still a lot of problems, such as:extended detention, the lack of supervision and investigation, as well as the meaningless existence of the supplementary investigation and so on. So the academic world pays a great attention to the supplementary investigation and has a lot of discussion about it. And the academic discussion mainly focuses on the following aspects:1,the dispute on its retention or abolition.2, the arguing of the candidate for abolishing between the Returning Supplementary investigation and the Self-conduct Supplementary investigation.3,the discussion over the abolishment and how to make use of the supplementary investigation at different phases.On the current status of research, the vast majority are still based on the sake of discussion, it is rare for a strategically advantageous position, although these researches has made some promotion of the academic prosperity but it is still hard to promote the deepening of the theory, so it is difficult to fundamentally solve the chronic problems of the existence of the investigation added. To this end, to add to the investigation and make new, full explanations of it is a pressing matter.This article attempts to figure out the fundamental causes and the basic ideas for the setting of the supplementary investigation system by analyzing the supplementary investigation system of our country. The thesis, at the same time, points out the problems which the supplementary investigation system in our country have to face and deal with, also makes an analysis of the system from the point of its basic ideas and the other concepts in the area of lawsuit aspect and so on, trying to put forward some reasonable and rational ideas and countermeasures for improving the supplementary investigation system in our country.
