Advice To Legal Regulation Transference Policy In Land Transference

In China, agriculture has a special status, and the rural land systerm is one of the important parts in basic system of rural economy. Change of land system plays a crucial role in the development and change of agriculture and even the whole socio-economy.The legal issue concerning transference of the rural contracted management rights turns to be a significant one we encountered under the current rural land reform. One effective way to achieve optimal allocation of resources is to tansfer the rignts for rural contracted management and ownership,therefore to secure and promote such transerence from law cames more concernful. Through studying on current status in transference of the land management rights, this paper has put forward with something unreasonable in legal rules, which has chained the development. On the basis of referring to foreign countries, we proposed some advice and ideas to speed up transference policy inculuding:principles in transference of rural land-use rights, real right reconstruction of contracted land, speeding up as stock-based business model. "Property Law" makes a clear rule on agricultural land management rights transferring, however, compared with the practical status, the content still appears to be fullfilled. With regards to the cases, this paper provides some more concerete and detailed recommendations, which we believe would utmost advocate the transference from law.
