A Study On Several Legal Issues Related To Protection And Indemnity Insurance

P&I is the abbreviation for Protection and Indemnity Insurance and it covers the risks including all the risks that ship-owners shall cover, except the part that the hull insurance has already covered. As a necessary complementary to the hull insurance, P&I insurance exerts an enormous impact on the development of international shipping industry. P&I insurance greatly enriches the meaning of marine insurance. Meanwhile, it profoundly challenges the current marine insurance legislation.This thesis is divided into five chapters except of introduction and concluding remarks. P&I insurance related legal problems are analyzed and expounded respectively.The first chapter is the summary of P&I, Introducing P&I insurance generation and development, the development situation of P&I club and the influence of liability insurance mandatory tendency to P&I insurance. Today in the development process of P&I insurance is still existing many problems.The second part of the thesis is the introduction of P&I club and its legal status. As the insurer of the P&I insurance, P&I club has a clear legal status is very important to the development of itself and P&I insurance. The author discusses this part according to the contrasting development situation of British and American countries and the actual situation in our country.In the third chapter, the author analyses the legal character of P&I insurance contract and its law application. He discusses the legal character of P&I insurance contract from the general to the particularity and then makes it clear. After that, with studying the foreign laws, he analyses the law application of P&I insurance contract in our country.The first chapter discusses the direct suits in P&I insurance. In this part,fist, the author researches and studies the legal system of Britain and then analyses the direct suits in the liability insurance in China according to the new Insurance Law. At last, the direct suits in P&I insurance can be clear. The last part is the suggestion to perfect the legal system of P&I insurance. Based on the importance of P&I insurance and the defects and deficiencies of the legal system of our country, the author pertinently shows his proposal on the modification of legislation.
