Trust coming from Anglo-American law is the production of particular England history, culture and judiciary, and it shows the characteristic of Anglo-American law theory and judiciary. Trust property is certainly in the core of trust, if there is no identified and independent property, there is no trust. And then, the independence is a very important character of trust property. The trust property independence characteristic means although the trust property belongs to the fiduciary, but the property is restricted by the objective of trust, it's objective property based on the trust objectives, was divided with trust three parties and controlled independently. Whereas, property independence is not a isolating concept, only when the series of integrated system including trust property, right and obligation distribution, the relevant loaners right protection based on this principle establish, the trust law can be inherited successfully and develop trust function. Therefore, in order to syncretize the trust into our country law system and consummate the relevant system design on the foundation of trust property independence, so that, the trust function can be developed absolutely.
