Analysis Of The Path To Establish And Perfect The Chinese Recent Administrative Supervision System

Executive power is the capacity of State administrative organs to manage the whole society for the sake of implementation of the national will by Constitutional principles. In the today′s society , people make one way or another connections with governments in different ways and to varying degrees. Therefore, more and more attentions are paid to the role of the governments. However, due to some features of itself, It is especially necessary to restrict the executive power.In part one, to begin with its features , It discusses the necesiety to restrict the Executive power .Because of its features such as mandatory ,extensiveness and personalized features , in the case of the lack of supvision from outside departure ,It is very easy to lead to variation , administrative corruption , violation of civil rights and departure from the public purpose and public interests .In part two , It discusses the concept and infrastructure of administrative power control mechanism . It includes administrative supervision system such as organs of state power supervision , judicial supervision , social supervision , and the internal supervision structure such as professional supervision from supervisory organs and audit .In part three, It analyses the practical reasons to establish and perfect the administrative supervision system from the point of view that there remain to be some problems in the administrative supervision system. These problems are as follows : the administrative oversight mechanisms of authority remains to be improved .There are some defects in the independence of judicial supervision . social supervision are very inadequate . It is difficult to play its due role for the executive self-monitoring . There are lack of coordination between different subjects of supvision and low-efficienc in the supvision.In part four , It analyses the path to establishment and perfection of Chinese administrative supervision system, and points out :we must effectively improve and strengthen the Supervision of the NPC ; we must protect the independence of judicial supervision : we must vigorously promote social supervision ; we should reform the administrative organs of self-monitoring system so that it is independent; we should strengthen the overall co-ordination between the supervision subjects , give full play to the overall supervision of the effectiveness.
