| As we know, we can full use of the property if the ownership is clear and definite. Since the Ownership, as the decisive factor for attribution of the property, is the title of the person's direct control of the rights, including the possession, use, proceeds and disposition. The affordable housing is now adopting the policy of "limited property right", which means the protected-person having the whole rights of using and possession of the house; however having the restricted rights of earning and disposition, namely, the protected-person has the restricted individual ownership against the property right of the house. However, due to the unclear definition of the property rights, the said policy is posing a series of issues, for example, the protected-person are abusing the rights they enjoy and disposing the house freely, which makes the macro regulation policy of real estate couldn't be carried out and also affects the function that the affordable housing was designed.Based on the above situation, during the formulating of the law of housing security, the department of housing security is trying to define the property right of the affordable housing as common property right, which means the government and the protected-person enjoy the same property right with a clear proportional and the government as the principal part, has the right to manage the affordable housing? Once the model of common property right was proposed, it has caused widespread controversy, the focus of which is how to carry out the said system under the adjustment of the Property Law.The author here attempts to analyze the system of Common Property Rights all-around, including the definition of the system and the theoretical basis, as well as particularities. The paper focuses on the coordination of the said system and Property Law, and try to find the convergence point of the two systems. At the end of the paper, the author forwards the suggestions to benefit the whole establishment of common property rights.
