Contracts are used extensively in society, parties engage in commerical activity through legal and effective contracts to reach the aim of trading. If the problems resulted from invalid contracts can not be settled, economic order will be in a mass,people's confidence in trading will shrink, and socail economy can not be developed normally. The writer brings together various views of invalid contract, and expresses my own views. For example,about legal nature of recovery of property, I think we should adopt all of the right to restitution and unjust enrichment claim of concurrence of opinion, and presented the reasons. At present, countries have their own requirements for the return of property of the applicable restrictions, according to the practice of forensic situation and problems, I puts forward my own proposal. In addition, invalid contract types have more problems in practice, the invalid contract of construction, invalid contract of housing and so on, I put forward my own solution. On the base of the realities in China, writer tries to analyze the legal effects of invalid contracts broadly and expects to be beneficial to the settlement of the mentioned problems.
