Bilateral FTA And Its Influence To Multilateral Trade System

The multilateral trade system of WTO has encountered serious setback. Economic globalization, as a result, is comparatively impeded, and meanwhile, Bilateral Free Trade Agreements(FTA) and Regional Rrade Agreements(RTA) hold priority in international economic exchanges and relations. FTAs,which concludes many new characters, such as the fast growing number, the inlarging area, the grate number of types and so on, are favored by the countries. Many countries thus try their best to adapt the foreign trade trend, taking measures to promote demostic economic.The Bilateral Free Trade Agreements, Which is a form of free trade agreement, exists as a exception of the multilateral free trade agreements.As the development of bilateral FTA,more and more countries pay more attention on conflics between bilateral FTA and multilateral trade system. Is bilateral FTA a spoil to multilateral trade system? There is no answer.As a trading state,China should not jump off the bilateral free trade system, but to conform to the trend, greatly involved into bilateal FTA.This thesis consits of four parts, Charpter One is about the developments of bilateral FTA.Besides the concept of bilateral FTA,its characteristics,the reason of the development have been convered. An introduction has been given to the origin and developments of bilateral FTA. Charpter Two is about the relationship between bilateral FTA and multilateral trade system. First is the WTO rules based on explanison of the existing basis of bilateral FTA in multilateral system. Most importantly are the 24th setion of GATT,"24th section of GATT interpretation Understanding", the 5th section of GATS, and Enabling Clause in 1979 and right licensing documents of developing countries to give its legal basement under the WTO multilateral trade system. Then it analyses three problem of rules and regulations of WTO to bilateral FTA. Charpter Three is about the influence to multilateral tade system. Firstly,it points out that the relation between them is complementary competitive. Secondly,it analyses that bilateral FTA has two sides,active and inactive influence to multilateral trade system. Charpter Four is about strategic choice of China. It first introduces the present situation China to bilateral FTA and some important bilateral FTAs that China has signed. Then it gives the shortages of China bilateral FTA, Finally,it gives some strategic suggestions to improve our bilateral FTA so as to make it a positive factor of stimulating our economy. Being the most effective developing country in the world, our country should devote itself to adjusting the progress of bilateral FTA to the WTO law system, and then improve demostic economy.
