Study On Compulsory Insurance System Of Railway Passengers

Chinese Railway Passenger Accident Compulsory Insurance System is built in the environment of material deprivation, low economic development and imperfect legal system, with the aim of protecting passenger's right for compensation. However, after years'progress in legal system, many other transportation industry has adopted voluntary insurance while only the railway industry sticks to its primary policy—compulsory insurance, which is inconsistent with realities. This article offers specific suggestion upon analyzing Chinese present insurance system and the relevant legal problems about accident compulsory insurance.There are four parts in total. The first part is a brief introduction to Chinese Railway Passenger Accident Compulsory Insurance system, including its characteristics, insurance period, insurance scope, implementation and exceptions. The second part is analysis about the compulsory insurance, including the necessity of its existence and also conflicts and problems in the present legal environment. The third part introduces relative systems in other transportation industry and other countries. By comparing with insurance system in air transport, sea transport, and road transport, with the relationship between compulsory insurance and other kinds of insurance analyzed, the author draw a conclusion of what could be learned from those experience. The last part proposes improvement suggestions, which are, adding carrier's compulsory liability insurance, reforming passenger's accident compulsory insurance to voluntary insurance, establishing a coordinated insurance of both kinds, and build a State Relief Fund for railway traffic accident.
