The Enlightenment From The System Of The New Plant Variety Protection In American To Our Country

The new plant variety originates from people's labor, As a result of the efforts of people, which has a great social economic value and society value. Along with the continuous progress of the breeding technology, as well as to the increasing of the demand for the high-grade seed and dependent intensity, which greatly stimulated plant breeders to develop new varieties of plants, thus objectively caused the national attention of new varieties of plants. As an agricultural country with the largest population, strengthening the protection of new varieties of plants goes without saying.This thesis tries hard to begin with the new plant variety and review our new plant variety protection system by comparison and analysis to the Protection System of China-US. Based on the balance of interests of the intellectual property rights, and combined with the experience of the USA, the author researches in-depth the problems involved in the system that in order to put forward feasible suggestions for our new variety of plant protection system. We also believe, which can achieve the same effect if we take full advantage of the existing laws and legislative technique.
