With the rapid development of economy, Traditional package tours are not satisfied with the way people travel preferences of the individual travel needs.Self-tourism is the rise of China in recent years as a way to travel, its freedom, flexibility, autonomy, stimulating the tourism enthusiasts and fast favorite.According to China's largest travel site-ctrip survey data:the number of people who like to select personalized forms of tourism has accounted for more than 80% of the total number of tourists. However, due to self-help tourism in our country is still new things, there are no related to the current domestic laws and regulations to address the growing number of self-help travel legal disputes, which makes our courts when faced with such problems could not find a suitable legal basis.For the only form of the legal aspects of the analysis on the case, the decision has often led to social controversy.Based on the above thinking, this thesis analyse from a legal perspective the principle of the application of tourist injuries compensation cases,in order to search for an appropriate solution. Full-text is divided into five chapters.The first chapter is to bring up the questions. At first,this chapter introduce injury of self-tourism case and the verdict which has caused wide concern in China in recent years.Then we raise the topic of this article, namely, injury of self-tourism cases attributable to tourism principles apply to the problem.The second chapter illustrate the self-tourism concept and the main categories of tourism, and introduce tourism in all aspects from the self-classification and the legal characteristics.The third chapter describes the self-help tourism activities of the main rights and obligations and our legislation on the status of self-help tourism, through analyse rights and obligations to clear legal relationship between the main body.The 4th chapter, through analyse "self-help Tour Mix casualties" in the case of the application of the principle of burden-sharing issue, with cases of actual and national self-help travel judicial status, intended to provide a theoretical basis for handling such cases in China.The 5th chapter, combined with the status of China's self-help travel and tourism environment, in order to improve the self-service travel accident relief, trying to protect tourists'interest.
